OTHER EVENTS.

On April 19, 2021, the arbitrator in the previously disclosed arbitration between VirnetX Holding Corporation and McKool Smith, P.C, (“McKool”), McKool Smith P.C. v. VirnetX, Inc., AAA Case No. 01-20-0003-7975, awarded McKool $36,322,708.79 in damages, plus pre-judgment interest in the amount of 5% simple interest from March 23, 2021 to April 18, 2021, and post-judgment interest in the amount of 5%, compounded annually, until payment of the award.
